Abstract
The formal legislational testing of the 1945 Constitution is naturally an effort to assure the protection of the
citizens’ constitutional rights from any absolute behaviors of the power holders because such absolute behaviors
may result in the breaking of the fundamental rights of the citizens, and to avoid this, justice and benefits in terms
of the proces of regulations in the forms of procedures, mechanism and the formation systems should be given as
much as possible to the citizens. The formal legislational testing of the 1945Constitution is intended to establish
better laws (leges condere legem melius mutato proposito) since in the legislational process, the principles of
establishment are often ignored.
